Kathmandu-The Sher Bahadur Deuba faction of the Nepali Congress has strongly rejected the Election Commission’s decision recognizing the special general convention led by Gagan Thapa and Bishwaprakash Sharma, describing the convention as a “so-called gathering” and announcing plans for political resistance and legal action.
A meeting of the Deuba faction held at the party’s central office in Sanepa concluded that the Election Commission’s decision issued on Magh 2, 2082 BS is contrary to the Constitution of Nepal, prevailing laws, the Nepali Congress statute, and precedents established by the Commission itself.
Issuing a statement, Krishna Prasad Poudel, Chief Secretary at the party office under the Deuba faction, said the Commission ignored documentary evidence, official correspondence, and past decisions made under Deuba’s leadership.
“The decision taken by the Election Commission regarding the Nepali Congress has been made in violation of the Constitution, existing laws, established precedents, and the party statute,” the statement said.
The Deuba faction alleged that the Commission acted unilaterally without properly assessing the legality, propriety, or number of participants in what it termed the “so-called special general convention”. It further accused the Commission of acting with malicious intent aimed at illegally replacing the duly elected Central Working Committee of the country’s largest democratic party.
According to the decision adopted at the meeting, the faction views the Commission’s move as part of a broader conspiracy to weaken Nepal’s democratic system. It has therefore decided to pursue constitutional and legal remedies, along with political protest, against the Commission’s ruling.
The meeting also authorized acting president Purna Bahadur Khadka to file petitions and initiate other legal proceedings at the Supreme Court challenging the Election Commission’s decision.
